BUSINESS RATES

Fleurets’ business rates consultancy service strives to achieve the best possible results for the ratepayer. Being leisure property specialists we are ideally placed to advise on hotel rates, restaurant rates, public house rates or, indeed, business rates on any leisure property. So whether you run a public house, restaurant, hotel or other leisure business, we will be able to advise you on your rating assessment.

Rating appeals regarding business rates in the leisure industry generally fall into 2 categories:

1. Compiled List Appeals

This involves challenging the business rates figure in the existing rating list (currently the 2010 Rating List). It is based on the rental value of the property as at the 1st April 2008.

We use our extensive database of market evidence and turnover information to determine whether the rateable value is within the right parameters and if an appeal is worthwhile.

2. Material Change of Circumstances (MCC) Appeals

MCCs exist where a physical change has taken place which has had an adverse effect on the trading potential of a particular operation, which should be reflected in the business rates.

These include:

  • competition opening in the local area,
  • major refurbishments of competition in the local area,
  • road closures adversely affecting access to the property, and
  • closures of major employers in the local area.

CONSULTANCY & LITIGATION

Fleurets is regularly instructed to provide advice for strategic portfolio reviews and for corporate mergers and acquisitions. We are also frequently asked for preliminary advice for banks and lenders when reviewing business plans or making administration and insolvency decisions.

PLANNING REPORTS

Public house closure can be problematic, particularly if the alternative provision of other licensed operations in the vicinity is limited.

This issue has led to the introduction of a Register of Assets of Community Value and Planning Policies. These were set out to help local amenities and are sometimes necessary and helpful, but sometimes they can restrict investment into an area that would replace an unviable licensed premises.
